THIS IS A LEGAL AGREEMENT BETWEEN YOU AND The Norfolk Cottage Company , of The Norfolk Cottage Company, 5 Old Stable Yard, Holt, Norfolk, UK. NR256BN governing the terms of your use of this Site. This Agreement (together with any annexure additions updates or revisions hereto) constitute the Agreement between you and The Norfolk Cottage Company .
 
Introduction and Definitions
 
Your access to, use of, linking to the Site, use of software or downloading software on the Site (collectively, your "Access") is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained on this page and elsewhere on the Site ("Terms of Use"). If you do not agree with the Terms of Use, leave this Site. This website (the "Site") is owned and operated by The Norfolk Cottage Company .
 
The Terms of Use of this Site do not affect your statutory rights as a consumer.
 
"You" and "Your" means the person using this Site to order goods and subject to these Terms of Use.

Disclaimers and Limitation of Liability
 
To the extent permitted by law, The Norfolk Cottage Company  provides this Site and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of this Site, or that it will be timely or error-free, that defects will be corrected, or that the Site or server that makes it available are free of viruses or other harmful components.
 
Subject to the previous paragraph, neither we nor our officers, agents, employees or contractors shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this Site.
 
Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence or that of our agents or employees.
 
Intellectual Property
 
You may not print, copy, reproduce, download, republish, broadcast, transmit, display, modify or re-use the materials from this Site for anything other than personal, non-commercial use, including in particular any purpose which publicly re-sells or re-uses the materials, without the prior written consent of the copyright holder.
 
All copyright, trade marks and other intellectual property rights in this Site and its content (including without limitation the Site design, text, graphics, logos, icons, images and all software, databases and source code connected with the Site) are owned by or licensed to The Norfolk Cottage Company or otherwise used by The Norfolk Cottage Company  as permitted by law.
 
Availability
 
This Site may be unavailable at certain times to allow for maintenance and upgrades. Although we will endeavour to notify customers in advance of any service unavailability, this cannot be guaranteed and we reserve the right to alter or withdraw the service at any time.
 
Indemnity
 
You must indemnify and hold harmless us and, our directors, officers, employees, agents, vendors, advertisers, partners and suppliers and keep them indemnified against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from your Access to and use of this Site, any breach or violation of the Terms of Use of this Site or your violation of any law or your violation of the rights of any third party.
 
Limitations of Use
 
This Site is intended to be accessed by persons located in countries free of UK government embargoes or sanctions and we make no representation that any information, materials or functions included in this Site are appropriate for use in any other jurisdiction.
 
By using this Site, you warrant that any personal information provided by you is true, accurate, current and complete in all respects and that you will notify us immediately of any changes to your personal information by updating your member profile on the Site or contacting us.
 
You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
 
To use our service you must be over 18 years of age.
 
Any passwords issued by this site should be kept confidential at all times, and must not be shared or disclosed to anyone. You are responsible for all activities and orders that occur or are submitted through your membership. If you know or suspect that someone has knowledge of your password then you should contact us immediately.
 
You may not use the Site for any unlawful or unauthorised purpose, including without limitation:
 Distributing any unlawful, libellous, abusive, threatening, harmful, obscene or otherwise objectionable material; Transmitting material that constitutes a criminal offence, results in civil liability or otherwise breaches any laws, regulations or codes of practice; Interfering with any other persons use or enjoyment of the Site; Damaging, disabling or impairing the operation of this Site or attempting to gain unauthorised access to this Site or to networks connected to it, through hacking, spoofing or other such similar means.
 
Feedback and User Submissions
 
We do not solicit nor wish to receive any confidential or proprietary information from you. Nor do we wish to receive any creative materials, ideas or suggestions other than those we specifically request.
 
If you do send to us by email or otherwise, any communication or material, you represent and warrant that the information and material is original to you, and you will be deemed to have granted us a perpetual, world-wide, royalty-free license to use such communications or material in any way we see fit and we will be free to use any such material or information contained in communications you send for any purpose whatsoever.
 
Termination
 
We reserve the right to decline a new registration, terminate your right to link to the Site, remove you as a user of this Site, and/or prevent any further use if you violate any of the Terms of Use. If we consider there to be a risk of liability or loss to us or our partner websites we may take any action deemed necessary to prevent such a liability or loss from occurring.
 
If we terminate your right to link to the Site you must cease linking to the Site immediately. Any person who holds a suspended or terminated membership must not order from or re-join this Site without our prior written consent. We reserve the right to assign or sub-contract any or all of our rights and obligations under these terms. Please note that we have the ability to trace your IP address, and if necessary, contact your ISP in the event of a suspected breach of these Terms of Use.
 
Enforceability
 
If any part of these Terms of Use are deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any of the remaining provisions of these Terms of Use.
 
No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.
 
Governing Law
 
The Terms of Use, Privacy Policy and any matter relating to this Site shall be governed by English law and any dispute shall be resolved exclusively in the courts of England.

THE NORFOLK COTTAGE COMPANY BOOKING CONDITIONS

Contract of Hire is between the Hirer and the Owner of the property for which the booking is made. The Norfolk Cottage Company act as Booking Agents for the property owners and a booking is not effective until The Norfolk Cottage Company provide written confirmation of that booking.

A deposit of 20% of the cost of the holiday, which is non refundable, should accompany the booking form. The balance is due eight weeks before the start of your holiday. If the booking is made within eight weeks of the holiday commencement date, the full accommodation rental amount will be required. The Norfolk Cottage Company reserves the right to cancel a holiday where full payment has not been received less than 21days before the holiday commencement date.

If you are forced to cancel your holiday due to unforeseen circumstances, you must inform The Norfolk Cottage Company in writing immediately. In all cancellation situations the deposit is forfeited. We will make every endeavour to re-let the property, but you will remain liable for full/part payment if we are only able to re-let part of the agreed period. We strongly advise you take out cancellation and travel insurance for your holiday.

Payment can be made by cheque or debit card. Only the deposit may be paid by a Credit card. Full amount and balance payments can only be paid by cheque or debit card.

The Norfolk Cottage Company charge an administrative booking fee of £20 to accompany holiday reservations. This amount should be included in your initial deposit. 

No liability is accepted for any injury, loss or damage to guests and/or their belongings, damage by or to any third party or for damage to any motor vehicle or its contents.

The maximum number of guests is restricted to numbers stated in the brochure/website. The Norfolk Cottage Company and the owners reserve the right to refuse admittance if this condition is not observed. In addition, The Norfolk Cottage Company and the Owners reserve the right to refuse entry/bookings from guests who may, in their opinion, be unsuitable for the property concerned.

The Hirer is responsible for taking care of the property during their stay. All equipment and contents must be left clean and tidy on departure, with the exception of linen to be laundered. If the property is left messy or dirty an additional cleaning charge will be levied.  The property must be securely locked when you are out and care taken not to expose the property to any fire risk. The Norfolk Cottage Company and the Owners reserve the right to enter the property at any reasonable time with or without any maintenance staff for the purpose of any repairs in the event that they may become necessary, although we will obviously respect your right to privacy and try not to disturb your holiday.

Any damage and/or breakages are the responsibility of the Hirer and the cost payable upon demand. Please inform us immediately so that items can be replaced in time for the next guests. The Norfolk Cottage Company and/or the Owner reserve the right to repossess the property at any time where serious damage has been caused.  The Norfolk Cottage Company reserves the right to request payment of a damage deposit should it be deemed necessary by the Owner.

The Norfolk Cottage Company take every care to ensure the accuracy of the property descriptions. All information in our brochures and on our website is given in good faith and is correct at the time of going to press. The Norfolk Cottage Company cannot be held responsible for changes beyond its control, which may become known after publication of literature. In addition, whilst we advertise properties as non-smokers only or no pets, as instructed by the Home Owner, we cannot guarantee the fact. The Norfolk Cottage Company cannot accept liability for happenings beyond its control, such as breakdown of domestic appliances, plumbing, wiring, temporary invasion of pests, damage resulting from exceptional weather conditions or the owner’s negligence resulting in loss, injury or accident. If internet access is advertised speed and connection cannot be guaranteed.

In the unlikely event that a property is not available through circumstances arising outside the control of The Norfolk Cottage Company or the Owner, then The Norfolk Cottage Company may be forced to cancel the booking. The hirer will be advised as early as possible. Where possible, The Hirer will be offered suitable alternative accommodation, which if not acceptable, will entitle the Hirer to a refund of all monies due. The Hirer will not as a result have any further claims against The Norfolk Cottage Company or the Owner.

Please note the party leader must be at least 18 years of age at the time of booking. The party leader must be authorised to make the booking on the basis of the Booking Conditions by all other members of the holiday party. By making the booking, the party leader confirms that he/she is so authorised and that all other party members agree that the booking is subject to the Booking Conditions.

Arrival and departure: Changeover day for the properties is usually Friday/Saturday for a full week’s booking. Short breaks are by arrangement. Guests must not arrive earlier than the stated time. We request that you vacate the property by the time given on departure day so we have time to clean the property and arrange laundry for incoming guests.  Key arrangements and directions will be given to you in advance of your holiday.

All utility services are included in the cost of your holiday. Fuel for open fires and wood burners are not included, guests can usually purchase these from local supermarkets and garages.

An extra charge of £15 per dog per holiday will be made.  Please make sure all evidence of your dog is removed and disposed of into a bin and not into the flower beds. Dogs are allowed on the understanding  they are not allowed on to  furniture or upstairs and are not to be left alone in the property.

Your cottage will be cleaned between lets and, if you are staying for two weeks linen will be changed halfway through your stay.

Should you have any problems arising during your stay please contact The Norfolk Cottage Company office in the first instance, when we will endeavour to assist you.  The Booking Contract is between you and the property Owner and any reasonable complaint which The Norfolk Cottage Company cannot resolve should be put in writing as soon as possible and the owner will address the matter.  The Norfolk Cottage Company's liability and that of the Homeowner is limited to the cost of your holiday, except in the case of liability for personal damage or injury, for which purpose the Cottage Owners carry Public Liability Insurance.  In no circumstances can complaints be made after the hire has ended, or where the hirer has denied the Agents or Owners the opportunity to try and put matter right during the hirers stay.
